Pursuant to the License Agreement, Apple also grants the Developer a limited, non-exclusive, personal, revocable, non-licensable, non-transferable license to use Apple Software for application development and testing. However, Apple reserves the right to limit the number of devices on which this software can be installed. Notwithstanding the foregoing, Apple reserves extensive termination rights that allow the Company to immediately terminate the License Agreement if, among other things, a developer: (a) cannot calculate or receive notice of a breach of contract within 30 days of notification of such breach, (b) in violation of confidentiality obligations under the Agreement; (c) a patent infringement action has been brought against Apple; (d) no changes to the License Agreement imposed by Apple are accepted, or include any false, fraudulent, inappropriate, illegal, or dishonest acts related to the License Agreement, including an attempt to conceal Apple`s features in its app code or falsify app ratings or encourage others to participate. As an applicant to the Apple Developer Enterprise Program on behalf of your organization, you must have the legal authority to bind your organization to legal agreements. You must be the owner/founder of the organization, a member of the management team, a project manager or have legal authority conferred on you by a senior executive. While the license agreement may last indefinitely, as described above, it grants Apple and the developer the right to terminate apps previously downloaded from the App Store during the term of the agreement.
